PRIVACY NOTICE

This is the Privacy Notice for the DHL Fulfillment Network Affiliate, namely individuals (“you), that promotes the DHL Fulfillment Network and refers potential customers to DHL Supply Chain Management GmbH (“DHL”, “we”, “us”) and aims to explain how we use the personal data we collect and what are the rights of the data subjects in relation to this Program. For the avoidance of doubt and without prejudice to the foregoing, DHL Supply Management GmbH shall be an independent controller of any personal data that it receives or shares with an Affiliate.

Definitions

In this Privacy Statement, unless otherwise defined herein, the capitalized terms below shall have the same meaning as in our Terms and Conditions.

How personal data is collected

In order to enroll and participate in the DHL Fulfillment Network Affiliate Program, we need to collect, store and process the personal data provided by you during the registration form (via the DHL Fulfillment Network website). The categories of personal data collected are outlined below:

In case of successful referrals, the following categories of personal data will be processed for the Commission and Payment performance, all in accordance with our Affiliate program Terms and Conditions:

Legal basis for processing your personal data

  • The above listed data processing is necessary for us to operate our Affiliate Program at your request as potential or accepted Affiliate, provide our services and comply with our obligations arising from the agreement concluded with you [ Article 6(1b) - Necessary for the performance of a contract or in order to take steps at the request of the data subject prior to entering into a contract].

Use of Cookies

This website uses cookies and similar technologies, (hereafter “technologies”), which enable us, for example, to determine how frequently our internet pages are visited, the number of visitors, to configure our offers for maximum convenience and efficiency and to support our marketing efforts. When you access our website, we inform you that technically necessary cookies are set and in addition, that your consent is required to the use of certain technologies, such as analytical cookies or similar technologies. How we will use personal data

We guarantee the confidential handling of your personal data in accordance with applicable data protection laws and the DHL Group Data Privacy Policy. In particular, DHL will use the personal data of Affiliates to operate the Affiliate Program, perform the Referral Process and execute the commission for successful referrals, all in accordance with our Affiliate Program Terms and Conditions.

How long is your personal data kept

We will keep your data for as long as your Affiliate account is active and necessary to fulfill our above purposes, to execute our contracts and to comply with any legal obligation. The retention period may differ per country based on applicable country laws.

We continuously strive to minimize the retention period of data where the purpose, the law or contracts allows us to do so.

For non-approved affiliate applications and non-successful referral, all applicant data will be deleted within 90 days from the day the application has been rejected.

Will my data be passed on to third parties?

In the context of the data processing as described in this Privacy Notice and the respective legal basis given, DHL Supply Chain will transfer your data to the following categories of recipients:

  • DHL Group companies: transfer is required within the DHL Group, its legal entities and shared service centers to provide and execute our service to you (e.g. In case of successful referrals, data processing by responsible local unit will occur to manage our relationship with you, to identify you and to comply with our payroll obligations towards you in accordance with the standardized payroll process implemented by the responsible local unit).
  • Third party processors: which process data are contractually obliged to maintain strict confidentiality as per Art. 28 GDPR. DHL retains responsibility for safeguarding your personal data in such circumstances. The business partners follow the instructions of DHL, and this is guaranteed by technical and organizational measures, as well as by means of checks and controls.
  • Public authorities: transfer is required by applicable law (e.g. to fulfil a legal obligation towards tax authority for rewards and additional payments).

Your data is only transferred outside the European Economic Area (EEA) to other DHL Group companies, third party business partners or public authorities when permitted by applicable data protection law. In such cases, we will make sure that appropriate safeguards are in place to ensure the transfer of your data (e.g. our binding corporate rules, standard contractual clauses).

Your rights as a Data Subject

  • Right to erasure of data about you that we are no longer allowed to store
  • Right to receive a copy of your stored data (potentially in electronic form)
