How to Make Sure You'll Get Customs Exemption on Original Goods

Many countries have signed trade agreements with Israel, which grant exemptions from customs duties on goods manufactured in these countries, subject to compliance with the conditions set out in the agreements:

  1. Compliance with the rules of origin: The goods must be manufactured in the country of origin, at a minimum rate of the finished product according to the arrangement set out in the agreement.
  2. Transportation directly from the country of origin to Israel.
  3. Attach original documents: An original signed certificate/declaration, in the exact wording set out in the agreement, must be attached. 

*The trade agreements grant an exemption from paying customs duties only and do not affect the purchase tax rate.

Trade Agreement with the European Union

The European Union was the first to sign a trade agreement with Israel and its main trading partner.

Criteria for Compliance with the Requirements of the Agreement

In addition to the requirements mentioned above, the importer must ensure that the sender attaches to the shipment a EUR1 certificate of origin or a supplier's account with a declaration of origin in the body

The invoice, in the form detailed below. The invoice must be acceptable and original (not a PROFORMA account).

Important Highlights in Filling out the EUR1 Certificate of Origin

  • Require the sender to scan and email the Certificate of Origin before the shipment leaves so you can make sure it's complete and in good working order!
  • The certificate must be printed.
  • Important fields in the certificate:

Field 2.  Countries of origin and destination: If the goods are manufactured in multiple countries included in the agreement, EU/EC or EEA must be specified.

Field 11.  Customs clearance in the country of export: The certificate must include a signature, stamp and date. The certificate is valid for 4 months from this date.

When do you need a preference account with a declaration of origin and when a EUR1 certificate is needed

  • For a shipment that has a value of less than €6,000 or is sent by an approved exporter, an exporter's declaration signed in the body of the invoice is sufficient.
  • For shipments with a value of more than €6,000 and the supplier/sender is not an approved exporter, a EUR1 certificate signed by the customs and export authorities is required.
  • An exporter who has been certified by the customs in the country of export as an approved exporter must stamp an unlimited declaration on the account.

According to the trade agreement between Israel and Europe in order to expedite the clearance process and prevent tax payments, you must attach the original, commercial invoice to the shipment with a Declaration of Origin (EUR1 Declaration) on it.

For invoice under 6000€:
The exporter of the products covered by this document declares that, except where otherwise clearly indicated, these products are of [-1-] preferential origin.

• [-1-]: The country from which the products were purchased has the status of country of origin. In the event of a group of countries, please note EU/EC or EEA.
• Please note the location and date of issue of the invoice, the full name of the exporter and signature.

Here are instructions for correctly filling out the EUR1 Certificate of Origin

Euro 1

The following is a list of countries included in the European Union:

 Austria, Belgium, Cyprus, Czech Republic, Estonia, Finland, France, Germany, Ireland, Italy, Greece, Hungary, Latvia, Lithuania, Malta, Malta, Portugal, Slovakia, Slovakia, Spain, Sweden, United Kingdom. EUR1 declaration/certificate of origin. Turkey is not part of the European Union, but the terms of the agreement between Israel and Turkey are similar to the agreement with the European Union. It also requires filling in other European countries that do not belong to the European Union and with which there is a separate agreement (the EFTA agreement): Norway, Switzerland, Iceland, and Liechtenstein.

FAQS:

I imported goods that meet the rules of origin but the certificate was revoked. What can be done?

As long as the shipment has not been released, it is possible to order alternative and acceptable paperwork for the purpose of exemption from customs payment, if necessary. Consult with the customs broker before clearance.

The shipping documents, including the certificate of origin, were lost on the way. What do you do?

You can issue a new certificate with a note in field 7 "DUPLICATE" (identical copy) along with the lost certificate number and the date of the customs clearance specified in it – as long as the shipment has not been released!

No certificate of origin was attached to the shipment. Can it be issued afterwards?

A CERTIFICATE OF ORIGIN CAN BE ISSUED WITHIN 30 DAYS OF EXPORT, NOTING A NOTE IN FIELD 7 "RETROSPECTIVE ISSUED" – AS LONG AS THE SHIPMENT HAS NOT BEEN RELEASED!

I received a EUR1 CERTIFICATE IN WHICH FIELD 7 SPECIFIED "PROCEDURE SIMPLIFIED" AND IT WAS DISQUALIFIED. Why?

Some European countries allow a "simplified process" in which the exporter receives pre-signed forms by customs and adds his signature at the time of shipment. Israel Customs does not accept these certificates and requires that the certificate be stamped by the exporter and customs on the same date.
