TERMS AND CONDITIONS APPLICABLE TO THE PROVISION OF EXPRESS COURIER AND PARCEL SERVICES FOR THE "EXPRESS DOMESTIC PREPAID" PRODUCT (HEREINAFTER REFERRED TO AS THE "PREPAID SERVICE")

IMPORTANT NOTICE:

By contracting the Prepaid Service from DHL Express México, S.A. de C.V. (hereinafter "DHL"), located at Avenida Fuerza Aérea Mexicana No. 540, Col. Federal, Alcaldía Venustiano Carranza, Mexico City, CP. 15700, with RFC DEM8801152E9, you, acting as the "Shipper and/or Customer," agree on your own behalf, on behalf of the receiver of the Shipment ("Recipient"), and on behalf of any person with an interest in the Shipment, that these Terms and Conditions shall apply.

1. Definitions

  • "Shipment" means all documents or packages that travel under a single air waybill and may be transported by any means DHL deems appropriate, including air, road, or any other mode of transportation.

  • "Waybill" and/or "Waybills" shall mean the document generated by the automated systems of DHL or the Shipper, which includes the complete information of the Shipment in question, pursuant to the provisions established by Mexican legislation.

  • "Purchase Order" shall mean the document detailing the price, quantities, and any additional information regarding the products acquired by the buyer.

  • "Prepaid Tool" shall mean the DHL commerce portal used to generate Prepaid Service Waybills, through which the Customer can manage, process, and administer them.

2. Pricing and Payment

The Shipper expressly acknowledges and agrees to pay DHL the total value stated in the Purchase Order for the Prepaid Service. This value will be calculated based on the rates published at the time of purchase in the Service and Rate Guide for the product named "Express Domestic Prepaid," available at: https://mydhl.express.dhl/mx/es/home.html. The Service and Rate Guide may be modified by DHL at any time without any liability.

3. Crediting of Waybills

Prepaid Service Waybills will be credited to the Shipper's profile generated within the Prepaid Tool according to the following timeframes:

  • a) Credited immediately if the total payment for the Prepaid Service was made using a bank card.

  • b) Credited within a maximum period of 24 to 72 hours if the total payment was made via bank transfer.

4. Validity and Expiration

  • Prepaid Service Waybills will remain valid in the Prepaid Tool for 18 (eighteen) months starting from the day they were paid to DHL. Once this period has elapsed, any unused Prepaid Service Waybills will be canceled and will not be accepted or refunded by DHL.

  • If a Prepaid Service Waybill has been printed and is not used within the following 7 (seven) calendar days, the Waybill can no longer be used; consequently, DHL will not issue any refund or reactivate the Waybill.

5. Service Drop-off and Exclusions

  • The Prepaid Service does not include home pickup. Therefore, the Shipper must personally visit any DHL Service Point to drop off the Shipment.

  • If the Shipper requests a pickup for Prepaid Services via MyDHL+ and/or a DHL Drop-off, DHL shall be entitled to return and/or hold the Shipment without any obligation to issue a refund.

  • The Prepaid Service applies only to domestic shipments, and delivery is not guaranteed at a specific time slot. Optional services cannot be contracted for the Prepaid Service.

6. Weight Restrictions and Auditing

  • Shipments made under the Prepaid Service cannot exceed the maximum weight limit of 1 (one) kilogram (actual or volumetric weight). It is the Customer's strict obligation to ensure that the Shipment falls within this limit.

  • Without prejudice to the weight restrictions applicable to the Prepaid Service, DHL will conduct periodic and general audits regarding the Shipper's use of the Waybills to verify compliance with the applicable service conditions. These audits may include, but are not limited to, validating the actual and/or volumetric weight of the Shipments, verifying the correct application of rates, ensuring proper use of Waybills, and inspecting any other operational or logistical elements to identify Shipments that exceed permitted parameters.

  • For such purposes, DHL may issue notifications it deems appropriate, pursuant to Section 13 of these Terms and Conditions.

  • If DHL verifies that a Shipment exceeds the maximum weight limit permitted under this section, DHL shall be authorized to:

    • (i) Reject the Shipment and invite the Shipper to purchase a product suitable for the Shipment's characteristics, without this implying any obligation to refund the previously used waybill.

    • (ii) Apply any of the penalties outlined in Section 13 of these Terms and Conditions.

7. Invoicing

If the Shipper does not request an invoice at the time of purchase, a generic invoice will be generated. The Shipper may only request a re-invoicing process by contacting the following email: facturacion.mx@dhl.com. The re-invoicing process can only be requested by the Shipper within the same calendar year in which the payment for the Prepaid Service was made.

8. Packaging Responsibilities

The Shipper must deliver the Shipment properly sealed and correctly packaged according to its nature for transportation by DHL. DHL shall be exempt from all liability for any damage suffered by the Shipment resulting from improper packaging. If the Shipper requires packaging materials, DHL can only provide a flyer or an envelope at DHL retail stores.

9. Cancellation Policy

Once the purchase of the Prepaid Service Waybills is completed through any of our sales channels, it cannot be canceled and is not eligible for changes, returns, or refunds.

10. Tool Registration and Security

The Shipper wishing to register for continuous use of the Prepaid Service must complete the required information in the registration section of the Prepaid Tool. DHL will confirm registration via an activation email, after which the functions of the Prepaid Tool can be used immediately. The Prepaid Tool can be accessed via the following link: https://prepago.dhl.com.mx/Prepaid/home/homepage.

  • DHL reserves the right to verify the authenticity of the email addresses provided and restrict access to users whose information is not properly confirmed.

  • The Shipper shall not share their access credentials for the Prepaid Tool. Specifically, the Shipper must maintain the confidentiality of the access and usage permissions assigned by DHL, protect them against unauthorized third-party access, and refrain from sharing them with unauthorized users. Only individuals who need to access the Prepaid Tool to perform functions on behalf of the Shipper shall be authorized by the Shipper ("Authorized User").

  • The Shipper shall notify Authorized Users of their obligations and obtain the corresponding commitment and liability from them. The Shipper acknowledges full responsibility for the safeguarding, handling, and use of the Prepaid Tool, including any shipments that may be requested by third parties through it. The Shipper agrees to notify DHL immediately of any unauthorized use of the account or password, or any other security breach.

11. Data Accuracy and Indemnification

Unless specifically indicated otherwise within the Prepaid Tool, the parties will provide all information electronically within the tool, including invoices. The Shipper shall ensure that all information provided to DHL through the Prepaid Tool is complete, correct, and accurate.

  • The Shipper shall be solely responsible for any damage or consequences that may arise from the use of false, incorrect, or incomplete information.

  • The Shipper shall fully indemnify DHL against all liability, costs, claims, demands, causes of action, damages, and expenses arising out of or in any way related to any breach and/or non-compliance with the provisions of this section by the Shipper during the use of the Prepaid Tool.

12. Purchase Limits

The minimum number of Waybills per Purchase Order for the Prepaid Service is 10. The maximum number of Waybills permitted per Purchase Order is 15,000. DHL reserves the right to review and modify this limit at any time.

13. Termination and Penalty Clauses

DHL may notify the Shipper of any breach of these Terms and Conditions, indicating the nature of the irregularity and the applicable measures.

  • If DHL identifies any breach of these Terms and Conditions, DHL shall be authorized, at its sole discretion, to terminate the Shipper's access to the Prepaid Tool. This termination will result in the immediate disabling of all generated and unused Prepaid Service Waybills, as well as the inability to generate new Waybills, without creating any right to a refund, compensation, or credit. The foregoing shall apply, including but not limited to, the following scenarios:

    • (i) Fraudulent, improper, or unauthorized use of the Prepaid Tool or the Prepaid Service.

    • (ii) Providing false, incomplete, or inaccurate information related to Shipment management.

    • (iii) Documenting Shipments that exceed applicable restrictions regarding weight, dimensions, or coverage.

  • Termination shall take effect immediately upon DHL's determination. Following such termination, the Shipper must cease all use of the Prepaid Tool and delete any copies or related materials, understanding that no previously acquired Waybill may be used thereafter.

14. Supplementary Terms

In everything that does not conflict with the provisions of this document, the Shipper accepts and acknowledges that courier and parcel services will be provided in accordance with DHL's standard Terms and Conditions of Carriage published on the website www.dhl.com.mx, or any documents and media that replace them, which may be modified by DHL at any time. By this act, the Shipper agrees to review and accept them at the time each shipment is made.

15. Privacy and Data Protection

In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties and its Regulations, DHL hereby makes available its Comprehensive Privacy Notice published at www.dhl.com.mx.

  • DHL will collect, store, and process the personal information provided by the Shipper in the Prepaid Tool as required to provide the Prepaid Service, in accordance with applicable laws and DHL's Comprehensive Privacy Notice.

  • The Prepaid Tool may contain links to third-party websites, such as the IXOPAY payment gateway ("Linked Sites"). These Linked Sites are not under the control of DHL, and DHL is not responsible for, does not store, and does not endorse the content of such Linked Sites, including any information or materials contained therein. The Shipper confirms that they have obtained the appropriate consent for any personal data owned by a third party that they have provided to DHL.

16. Agreement and Acceptance

By purchasing the Prepaid Service, the Shipper acknowledges and agrees that they have read and understood these Terms and Conditions, and commits to comply with all provisions set forth herein. It is the Shipper's responsibility to stay informed about any updates or modifications to these terms through our website or authorized communication channels.

17. Jurisdiction and Governing Law

Any controversy arising out of or related to these Terms and Conditions shall be subject to the jurisdiction and applicable laws of Mexico City. The Shipper irrevocably submits to such jurisdiction unless applicable law dictates otherwise. However, if applicable legislation allows for a choice of forum or jurisdiction, it shall be determined by DHL.

18. Severability

If any clause or part of these Terms and Conditions is found to be null, void, or ineffective, the remaining portions of the Terms and Conditions unaffected by such nullity or ineffectiveness shall remain in full force and effect.
